Terms of service

Welcome to Gifts by Enso. These Terms of Service ("Terms") govern your use of giftsbyenso.com (the "Site") and any purchase you make from us. Please read them — placing an order means you accept them.

The Site and store are operated by Enso Ventures, a proprietorship registered in Bengaluru, Karnataka, India, trading as Gifts by Enso. In these Terms, "we", "us" and "our" mean Enso Ventures; "you" means the person visiting the Site or placing an order.

1. Who you’re contracting with

Your contract of sale is with Enso Ventures. Our store is hosted on Shopify, and payments are processed by third-party payment providers, but neither Shopify nor any payment provider is a party to your purchase — they provide the technology, we provide the product.

2. Eligibility

You must be at least 18 years old, or be using the Site with the involvement of a parent or guardian, to place an order. By ordering, you confirm that the information you give us is accurate and that you are authorised to use the payment method you have chosen.

We currently sell and ship within India only. Orders with delivery addresses outside India will not be accepted.

3. What we make, and how it will look

Every Gifts by Enso piece is a layered paper-cut artwork, cut and assembled by hand.

You should expect small variations between one piece and the next — in cut edges, layer alignment, paper grain and shade. This is inherent to handmade work and is a feature of what you are buying, not a defect.

Colours on your screen will not match the physical product exactly. Screen calibration, lighting and photography all shift how paper colour reads. Product photographs are representative; they are not a colour guarantee.

Dimensions listed are approximate and measured to the outer frame unless stated otherwise.

4. Personalisation and the content you send us

Most of our products are made to your specification — a name, a date, a message, a photograph or a sonogram image (“Your Content”).

Accuracy is your responsibility. We reproduce exactly what you enter at checkout or send us, character for character. Please check spellings, dates and photo orientation carefully before confirming. Section 5 of our Returns & Refund Policy explains what happens if there is an error on either side.

By submitting Your Content, you confirm that:

you own it, or have permission from whoever does, to have it reproduced by us;
it does not infringe anyone’s copyright, trademark, privacy or publicity rights;
where it shows an identifiable person, you have that person’s consent (or, for a child, the consent of their parent or guardian); and
it is not unlawful, obscene, hateful, defamatory, or otherwise objectionable.

You grant us a limited licence to store, reproduce, adapt and print Your Content solely for the purpose of producing and delivering your order, and to retain it for a reasonable period afterwards in case you reorder. We do not use Your Content for marketing, social media or portfolio purposes without asking you separately and getting your agreement.

We may decline an order. We reserve the right to refuse or cancel any personalisation request — with a full refund — if we believe it breaches the above, is offensive, or is technically unsuitable for our process. We are not obliged to review Your Content, and doing so in one case does not oblige us to in another.

5. Orders, acceptance and pricing

Your order is an offer to buy. A contract forms only when we send you a confirmation that your order has been accepted. An automated order-received acknowledgement or a payment receipt is not acceptance.

We may decline an order where the item is unavailable, the personalisation cannot be produced, we suspect fraud or a reseller purchase, or the price or description was listed in error.

Pricing. All prices are in Indian Rupees and, unless stated otherwise, are inclusive of applicable GST. Shipping charges, where they apply, are shown at checkout before payment. We may change prices at any time, but changes do not affect orders already accepted.

Errors. Despite our care, the Site may occasionally contain a pricing or description error. If we discover an error affecting an order you have placed, we will contact you to confirm whether you wish to proceed at the corrected price, or cancel for a full refund. We are not obliged to sell at an incorrect price.

Stock and availability. Product availability shown on the Site is indicative. Where a design is discontinued or materials are unavailable, we will tell you and offer an alternative or a refund.

6. Payment

We accept the payment methods shown at checkout, which may include cards, UPI, net banking, wallets and Cash on Delivery.

Payments are handled by third-party payment gateways under their own terms and privacy practices. We do not receive or store your full card details.

Cash on Delivery. COD orders are produced to order in the same way as prepaid orders. Refusal of a COD parcel at the door imposes a real cost on us; the consequences are set out in Section 5 of our Returns & Refund Policy. We may withdraw COD as an option for particular addresses or order values at our discretion.

7. Shipping and delivery

Delivery timelines shown on the Site or at checkout are estimates, not guarantees. Because each piece is made to order, our stated production time runs before dispatch.

Risk in the goods passes to you on delivery to the address you provided. Title passes on full payment.

You are responsible for giving us a complete and correct delivery address and a reachable phone number. Where a parcel fails or is returned because of an incorrect address or repeated unavailability, reshipping charges apply.

8. Returns, refunds and cancellations

Because our products are personalised and made to order, returns work differently from a general retail store. Our Returns & Refund Policy forms part of these Terms and sets out in full:

that personalised items cannot be returned for change of mind;
your 7-day window to report a damaged, defective or incorrect item, with photographs and an unboxing video;
your choice of refund or replacement on a valid claim; and
your right to cancel free of charge within 24 hours of ordering, or before production begins.

Nothing in these Terms or that policy limits your rights under the Consumer Protection Act, 2019.

9. Care, safety and intended use

Our products are made of paper, card and glass or acrylic, mounted in a wooden or composite frame. They are decorative keepsakes, not toys.

Keep away from moisture, direct sunlight and heat. Paper fades and warps; sun damage is not a defect.
Frames intended for a child’s room must be mounted securely by an adult and kept out of reach of young children.
Do not attempt to open, reframe, clean or repair the piece yourself. Doing so voids any claim under our Returns & Refund Policy.
Use the sawtooth hook or easel stand as supplied, on a surface or wall able to bear the weight.

We are not liable for injury or damage arising from improper mounting, modification, or use of a product other than as intended.

10. Our intellectual property

All designs, artwork, cut patterns, layered compositions, photographs, text, graphics, logos and the “Gifts by Enso” name and marks on the Site are owned by or licensed to Enso Ventures and are protected by Indian and international intellectual property law.

Buying a product gives you ownership of that physical object. It does not give you any rights in the underlying design.

You may not, without our written permission:

reproduce, trace, digitise, scan or copy our designs or cut files;
make derivative works from our artwork;
resell our products commercially, or use images of them to sell your own; or
use our brand name, logo, product photographs or copy in your own listings, advertising or store.

You may photograph a piece you own and share it personally, including on social media. We’d love it if you tagged us.

11. Reviews, photos and feedback you post

If you submit a review, photograph, testimonial or comment to us or on our channels, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including in marketing, with attribution to your first name or handle.

You are responsible for what you post. We may remove content that is unlawful, misleading, abusive or unrelated. We do not pay for reviews, and we do not remove genuine negative reviews merely because they are unfavourable.

Any suggestion or idea you send us about our products may be used by us freely, without obligation or compensation.

12. Acceptable use of the Site

You agree not to use the Site to: break any law; infringe anyone’s rights; upload malicious code; scrape, data-mine or systematically copy our content or images; interfere with the Site’s operation or security; impersonate anyone; or place fraudulent or speculative orders.

We may suspend or terminate your access, and cancel pending orders, if we reasonably believe you have done any of these.

13. Third-party links and services

The Site may link to third-party sites or services we do not control. We are not responsible for their content, products, or practices, and a link is not an endorsement. Your dealings with them are between you and them.

14. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any content is complete, accurate or current.

This disclaimer applies to the Site and its availability. It does not exclude our responsibility for the products we sell you, which is governed by Sections 7 to 9 and by consumer law.

15. Limitation of liability

To the maximum extent permitted by law, our total liability to you arising out of or relating to any order is limited to the amount you paid for that order.

We are not liable for indirect or consequential losses — including loss of profit, loss of opportunity, or distress arising from a gift not arriving in time for an occasion — even where we were told the occasion in advance. If a deadline is critical to you, please tell us before ordering so we can advise honestly on whether we can meet it.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act, 2019.

16. Indemnity

You agree to indemnify us against any claim, loss or expense arising from Your Content — in particular any claim that material you sent us for personalisation infringed a third party’s rights — or from your breach of these Terms.

17. Privacy

Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

18. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including courier disruption, natural events, strikes, civil unrest, power or network failure, epidemic, or government action. Where such an event materially delays your order, we will tell you and you may cancel for a full refund of anything not yet produced.

19. Changes to these Terms

We may update these Terms from time to time. The version published on the Site when you place an order is the version that applies to that order. Continued use of the Site after a change means you accept the updated Terms. We recommend checking the “last updated” date above.

20. Grievance redressal

For any complaint about the Site, an order, or these Terms, you may contact our grievance officer, appointed under the Consumer Protection (E-Commerce) Rules, 2020:

We acknowledge complaints within 48 hours and resolve them within one month of receipt.

21. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to your rights under consumer protection law to approach a consumer forum where you reside, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of these Terms.

22. General

Severability. If any provision of these Terms is found unenforceable, the rest remain in force.

No waiver. If we do not enforce a right, that is not a waiver of it.

Assignment. You may not transfer your rights under these Terms without our consent. We may assign ours in connection with a transfer of our business.

Entire agreement. These Terms, together with our Returns & Refund Policy, Shipping Policy and Privacy Policy, form the entire agreement between us regarding your use of the Site and any order.

Language. These Terms are drafted in English, which governs their interpretation.
